Bidding on this Website constitutes acceptance by Bidder of all the Terms and Conditions of Sale as stated herein. Registration: Registration is required prior to bidding on any item. This auction site is only available to people who are legally able to form binding contracts as the buyer of an auction item. People who are of under the age of 18 are not eligible to use these auction services. Registered users must give their real name, address, and contact information. The information collected during the registration process is used to communicate with the bidder about the auctions, as well as to facilitate the payment process. U.S. PAS may follow up registration with phone confirmation of account set up. U.S. PAS respects the privacy of its users and does not share this information with any third parties, except where required by law. At this time, registration is only open to Merchandise Descriptions: ALL LOTS ARE SOLD "AS IS" AND WITH ALL FAULTS. PURCHASER HEREBY ASSUMES ALL RISKS CONCERNING AND RELATED TO THE GRADING, QUALITY, DESCRIPTION, CONDITION, AUTHENTICITY, AND PROVENANCE OF A LOT. Weight, size, estimated value, origin, quality, age, condition, rarity, and importance, are not guaranteed for any item. Oral statements made by representatives of U.S. PAS shall not convey a warranty of any kind, implied or expressed, with respect to any of the above-mentioned characteristics. U.S. PAS provides a limited guarantee on auction item listing descriptions as described below: Guarantee of gem stone categorical description (i.e.- a diamond is guaranteed to be a diamond). Guarantee of gold karat description (i.e. 14K, 18K,…). Guarantee of watch make. Watches may be pre-owned and it is assumed that watches have after-market accessories which are not of the same make, such as diamond dials, bezels, or bands, unless otherwise stated. U.S. PAS guarantees hand signatures of artists, athletes, and other notables, to be authentic. Gold and silver coins are guaranteed to be genuine. However, condition and grade are not guaranteed, as these are a matter of opinion.Estimated values may or may not be given for any particular lot. The estimated value represents U.S. PAS’s opinion of the price a lot might bring at auction. The actual selling price could be significantly different from estimates. U.S. PAS will not be liable if the actual selling price is different from the estimate. In any case, estimated values are not guaranteed. Bidding Process: Registered users may place bids on any of the items up for auction on the Website. By bidding, the user is entering into a legally binding contract, so U.S. PAS encourages all bidders to examine the items. Bids are considered final so bidders are encouraged not to bid unless certain of their ability and desire to pay for an item at said bid price. U.S. PAS reserves the right to require deposits to secure bids. Occasionally, items will be sold with reserves, with or without advance notice. U.S. PAS reserves the right to bid on it own behalf or for the benefit of any consignor up to the reserve amount on any item. Bids must be for an entire lot and each lot constitutes a separate sale. No lot will be broken up unless otherwise permitted by the Auctioneer. Bids must be made in standard bidding increments as set forth on the Website for the subject sale. U.S. PAS shall have the right in its sole and absolute discretion to adjudicate all bidding disputes and shall have the right, but not the obligation, to rescind the acceptance of any bid and re-auction the item. Certain lots may be constrained due to contract and may be subject to confirmation. All sales are final. Disputes: If a bidder establishes that the item description of purchased property is grossly and materially inaccurate, said bidder must give written notice of discrepancy to U.S. PAS by email or certified mail within 14 calendar days of purchase. If bidder proves such assertions to the satisfaction of U.S. PAS, the sale of said lot will be withdrawn. Bidder will receive RA number (Return Authorization Number) as well as return instructions. Upon receipt of the merchandise, in the same condition it was at the time of the sale, U.S. PAS will refund to bidder the full purchase price, which includes hammer price, and any applicable buyer’s premium, and any taxes paid. No other costs that the bidder sustained will be refunded to the bidder, including costs for transportation or insurance. NO UNAUTHORIZED RETURNS OR PACKAGES WITHOUT VALID RA#S WILL BE ACCEPTED BY Settlement: The successful bidder is obligated to pay in full for the item bid upon. Fees include the winning bid amount as well as the flat shipping and handling fee, which is indicated in the item description. NOTE: Shipments to Alaska and Hawaii may incur higher shipment fees. In addition, Maryland residents will be required to pay 5% sales tax which will be added to the final purchase price. To claim exemption from sales tax, a valid resale certificate must be presented upon checkout. If necessary, please email customer support in order to request the appropriate form. Payment of the hammer price, buyer’s premium, shipment fees and any applicable taxes must be made within three days of the conclusion of the auction. We welcome Visa, MasterCard, American Express, and Discover. Payments are to be made securely from our website. If preferred, customer may contact us to make payment over the phone. Any payment not made to U.S. PAS within three business days of the auction is deemed to be late. U.S. PAS reserves the right to rescind the sale, pursue legal action against any late payer and to bar him/her from future auctions. All return privileges are voided by late payment. Any tax not paid by Bidder which should have been paid even if not collected by U.S. PAS by mistake, error, or gross negligence, Bidder agrees to promptly pay on demand together with any interest or penalty that may be assessed. Shipment: Upon receipt of payment in full, U.S. PAS will ship the item to the shipping address indicated during the registration process. If the shipping address is different than the billing address, further documentation may be required. Most items should be shipped within seven to ten business days of payment. Please note that in the case of larger merchandise (i.e.- furniture) shipping transit time may be longer than the usual time. Shipping and handling costs are noted in the description of each lot, and include shipping, handling, and insurance coverage.
